Agreement to Terms

Whalebone is a trade name of Things Things Things LLC ("Whalebone", "we", "us", or "our"), 1401 Dean St Apt 1, Brooklyn, NY 11216, United States. We operate the website at whalebone.shop and the checkout at checkout.whalebone.shop (together, the "Site"). The checkout is powered by Shopify.

By accessing or using the Site, or by placing an order, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Site or purchase from us.

By agreeing to these Terms you represent that you are at least the age of majority in your state or country of residence, or that you have the consent of a parent or guardian to use the Site.

Products and Orders

Product Descriptions

We strive to display our products as accurately as possible. Colors and finishes may appear slightly different on your screen due to monitor settings and lighting conditions. Each stand is made individually, so minor variations in texture, layer lines, and finish are normal and part of what makes each piece unique.

Pricing

All prices are listed in US dollars and are subject to change without notice. Prices do not include shipping costs or any customs duties or import taxes, which are calculated at checkout or charged by the destination country. We reserve the right to correct pricing errors, including after an order has been placed; if we do, you may cancel the order for a full refund.

Order Acceptance

Your order confirmation does not constitute acceptance of your order. We reserve the right to refuse, limit, or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraud. If we cancel your order, you will receive a full refund.

You agree to provide current, complete, and accurate purchase and account information, including your email address, billing, payment, and shipping details, so that we can complete your order and contact you about it.

Custom Orders

Products configured through our 3D stand builder are made to order. Custom orders cannot be modified once production has begun. Please review your configuration carefully before placing your order.

Custom orders cannot be returned unless there is a defect. Because custom orders are made specifically for you, they cannot be resold. If your custom order arrives with a defect or quality issue, we will replace it free of charge under our lifetime guarantee.

Payment

We accept major credit cards, debit cards, and the other payment methods displayed at checkout. All payments are processed securely through Shopify Payments; we do not store your full card details. You agree to provide current, complete, and accurate payment information for all purchases.

By submitting your order, you authorize us to charge the total order amount to your payment method.

Shipping and Delivery

Shipping methods, costs, processing times, and delivery estimates are described in our Shipping Policy. Shipping cost is calculated at checkout from your delivery address and the combined weight of your order.

Risk of loss and title for items pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control. International orders may be subject to customs duties and import taxes, which are the responsibility of the recipient.

Returns, Refunds, and Lifetime Guarantee

Non-custom items may be returned within 30 days of delivery. Every Whalebone stand is covered by a lifetime guarantee against defects. The full terms, including how to start a return or a guarantee claim, are in our Returns & Guarantee policy. By making a purchase, you agree to that policy.

Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs, 3D models, photographs, and software, is the property of Things Things Things LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Site without our express written permission. "Whalebone" and the Whalebone logo are trademarks of Things Things Things LLC and may not be used without our prior written consent.

Acceptable Use

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site for any unlawful, fraudulent, or malicious purpose, or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to any portion of the Site, its systems, or the accounts of others
  • Interfere with or disrupt the Site, its servers, or its security or authorization features
  • Use any robot, spider, scraper, AI agent, or other automated means to access the Site or extract its content without our permission
  • Transmit malware, viruses, or other harmful code
  • Collect or harvest personal information from other users
  • Impersonate any person or entity, or transmit false or misleading information
  • Send spam or other unsolicited promotional material through the Site
  • Harass, abuse, or harm our staff or any other person
  • Infringe the intellectual property or other rights of others

We may suspend or terminate your access to the Site, and refuse or cancel orders, if we determine that you have violated these Terms.

Third-Party Services and Links

The Site may contain links to third-party websites or rely on third-party services (such as payment processors and shipping carriers). We are not responsible for the content, accuracy, or practices of third parties, and any dealings you have with them are solely between you and that third party. Please review the applicable third party’s policies before you transact with them.

Errors, Inaccuracies, and Omissions

Occasionally there may be information on the Site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and to update information or cancel orders if any information on the Site is inaccurate at any time without prior notice, including after you have submitted your order.

Disclaimer of Warranties

EXCEPT FOR OUR LIFETIME GUARANTEE AGAINST DEFECTS AS DESCRIBED IN OUR RETURNS & GUARANTEE POLICY, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that information on the Site is accurate, complete, or current. Some jurisdictions do not allow the disclaimer of implied warranties, so some of the above may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL THINGS THINGS THINGS LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE PURCHASE OR USE OF ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising from your use of the Site or purchase of products shall not exceed the amount you paid for the product(s) at issue. Some jurisdictions do not allow the exclusion or limitation of certain damages, so in those jurisdictions our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Things Things Things LLC, Shopify, and their respective owners, officers, employees, agents, contractors, licensors, and service providers from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or the policies they incorporate, your violation of any law or the rights of a third party, or your use of the Site.

Governing Law

These Terms and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York, and you consent to venue and personal jurisdiction in those courts.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to the Site, and the "Last updated" date above will change. Your continued use of the Site after any changes constitutes your acceptance of the new Terms. Orders are governed by the Terms in effect when the order was placed.

Severability, Waiver, and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to exercise or enforce any right or provision of these Terms does not waive that right or provision.

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Guarantee policy, constitute the entire agreement between you and us regarding the Site and your purchases, and supersede any prior agreements or communications.
